Phil’s practice focuses on civil and commercial litigation and arbitration. Phil has experience in commercial law, bankruptcy and insolvency, labour and employment law, tax law, disciplinary law, estate law, real estate law, and private international law. He has particular expertise in urgent and extraordinary recourses, including seizures before judgment (and their quashing), stays of execution, and the revocation of default judgments.

Founder of the firm, Phil has acted in more than 120 files, the majority of which involved complex legal issues, risks of hundreds of thousands or millions of dollars and multiple defendants. He has appeared before the Court of Québec, each civil division of the Superior Court, and the Court of Appeal. He has also appeared before administrative tribunals, notably on issues relating to securities, labour law, and access to information.

In commercial law, Phil has represented a multitude of companies operating in various fields before the courts and advised them on dispute resolution, risk management, and strategic planning. He has acted for shareholders in disputes and oppression claims. He has represented companies in penal and regulatory investigations opened by the Autorité des marchés publics, the Autorité des marchés financiers and Revenu Québec.

In bankruptcy and insolvency law, Phil has represented insolvent companies in settlements with their creditors and in proceedings relating to defaults to bankruptcy proposals. In the past year, Phil succeeded in reaching a settlement that allowed a company which operates the only radiology clinics in the Gatineau region to avoid bankruptcy days before trial. Phil has also represented business owners in insolvency events resulting from loan guarantees. He represents individuals in connection with allegations of defaults to bankruptcy proposals and objections to their discharge. He has often been called upon to facilitate relations between debtors and their bankruptcy trustee. Phil has developed particular expertise in cases involving insolvent medical professionals. He currently acts in a Court of Appeal file that raises novel questions of law relating to the jurisdiction of a Superior Court judge sitting in the Civil Division to act pursuant to the Bankruptcy and Insolvency Act.
In real estate law, Phil has represented owners of immovable property in files relating to construction defects, misrepresentations in the sale process, and the interpretation of commercial leases.

Phil has extensive experience in tax law and securities regulation. He was formerly licensed as an Exempt Market Dealer and Chief Compliance Office of an Exempt Market Dealer and is a financial planner. He has advised clients on tax and estate planning and exempt markets. Phil has assisted many of his clients in regulatory and tax investigations initiated by provincial and federal tax authorities and the Autorité des marchés financiers – and in tax regularisation. He frequently acts in urgent situations following administrative seizures (“freezes”) of bank accounts. He has obtained settlements at all stages of the investigation process, from voluntary disclosures to the management and contestation of requests for disclosure of documents to the assessment and review of amounts owed and penalties. Phil’s in-depth knowledge of accounting enables him to administer complex proof of ability to pay when required. For example, in the past year, such evidence was used to reduce a company’s monthly payment agreement from $15,000 per month to $2,000 per month. In the rare cases where tax authorities pursue forced execution, Phil is prepared to challenge these measures before the courts. For example, in the past year, Phil prepared an urgent file in less than a week to contest a seizure in escrow of sums owed to a medical professional that would have rendered their business insolvent. Revenu Québec withdrew its seizure the day before the application for a stay was scheduled to be heard by the Superior Court.
In labour law, Phil has represented employers in investigations opened by the Commission des normes, de l’équité, de la santé et de la sécurité au travail (CNESST). He has also represented workers before the Tribunal administratif du travail and the Superior Court, as well as in numerous settlements with their former employers following dismissal or other disciplinary sanctions. Phil has particular expertise in the law governing relations between unionised employees and their union. He has been instructed on several occasions to interact with unions by employees who felt that their union did not represent them adequately. In the last year, Phil represented four employees before the Tribunal administratif du travail in disputes alleging violations of the duty of fait representation. Two of these cases were settled shortly before the hearing.

In disciplinary law, Phil has represented professionals in investigations initiated by their professional orders. He represents professionals before their Disciplinary Council and courts, including the Court of Appeal.

In estate law, Phil represents heirs when liquidators violate their obligations and to contest the validity of wills. He has been called upon to initiate proceedings to obtain wills for the purpose of nullification under article 484 of the Code of Civil Procedure.

Phil has particular expertise in urgent and extraordinary recourses, having obtained seizures before judgment (and their quashing), stays of execution, and the revocation of default judgments within days of his appearance in certain files.
Some of Phil’s cases include foreign elements, such as assets and witnesses in foreign jurisdictions or contractual clauses requiring the application of foreign law. Phil is familiar with the principles of private international law relating to choice of forum and declinatory exceptions. He has also acted in cases involving arbitration clauses.

Phil has obtained favourable settlements for his clients at all stages of litigation and prior to its institution, to empower his clients to move on to the next stages of their personal and professional lives. Phil recognises that complex litigation is often instituted for reasons that do not directly relate to legal considerations, and that its resolution requires a sophisticated understanding of underlying personal and business issues. Phil has a reputation as an effective and reasonable negotiator. He is always open to settlement discussions, but is well-prepared when certain issues need to be brought before a Tribunal.

Some of his proudest achievements are battles he fought while working for free. From helping a father get his access rights back to helping a student convince a post-secondary institution to revoke its policy regarding service animals, Phil is privileged to be able to help those who otherwise could not be heard. Most recently, Phil convinced the Superior Court to reject a settlement that would have prevented 2 million Quebecers from obtaining compensation from Uber.

Phil received his civil law and common law degrees from McGill University’s Faculty of Law. He was named to the Dean’s Honour List and received awards for the highest standing in property and constitutional law. He subsequently obtained his LL.M. as a Bombardier Scholar and a Ph.D. from Osgoode Hall Law School, which he completed in two years while working full-time. Phil is admitted to the bars of New York, Massachusetts and Quebec. He is also a Fellow of the Chartered Institute of Arbitrators and a Financial Planner.

Phil was a professor of law at Lakehead University and the Université de Moncton. At the time of his appointment and throughout his tenure, he was the youngest law professor in Canada. Early in his career, he also clerked at the Federal Court of Canada.
Phil is the author of more than 25 scientific articles, most of them peer reviewed. His research focusses on public law (mainly employment law and tax law), behavioural economics and new religious movements. A free version of each of his articles can be downloaded here.

Phil tries to invest some of his spare time getting out of his comfort zone. He has visited 42 countries and run three marathons (before putting on a lot of weight). He has walked 1500 kilometres through Spain and Portugal to Santiago de Compostela. It was there that he got the idea to start climbing the Seven Summits.

A versatile lawyer, Philippe Tadros has a wide range of experience in many areas of law.
After completing two years of university studies in criminology, Philippe went on to study law, earning degree in civil law from the University of Ottawa.

During his studies, Philippe was named to the Dean’s Honour Roll and was awarded a scholarship for academic excellence. He has also worked as a volunteer for Le Gîte Ami in Gatineau.

He began his career in law by articling with the Director of Criminal and Penal Prosecutions (DPCP), as a prosecutor in a variety of cases. He gained experience pleading before the Courts.

Philippe then joined a team specialising in prison law, where he learned to manage a high-volume practice and interact with a diverse clientele. He quickly learned the value of adaptability. Driven by a desire to defend the rights of litigants, Philippe joined the mylawyer inc. team, where civil litigation is the main focus of his practice.

Philippe practises law in both official languages. He has a passion for sports and was a member of the Quebec tennis team and was selected for the Egyptian national hockey team.
